Talking to ILNA, Mohammad Mostafaie said that his client Sasan Aghayi was arrested on November 22. He was subsequently indicted by a magistrate at the 3rd security branch of the Prosecutor’s office for acting against national security, disrupting public order and spreading lies.
According to Mostafaie, the case has been assigned to the 28th branch of the Revolutionary Court and the judge has decided to extend Aghayi’s detention order. Mostafaie finds the detention order excessive and incommensurate with the severity of the charges, the evidence produced by the prosecution, and his client’s past history. He also points out that his client does not pose a flight risk.
The pre-trial detention period shall not exceed the minimum punishment required by penal law for any given crime, said Mostafaie, arguing that his client’s 3-month detention exceeds the limit defined by the law.
The judge in charge of the case at the Revolutionary Court ignored Mostafaie’s objection to his client’s ongoing unlawful detention, forcing the lawyer to file a complaint to the Revolutionary Court. In a letter, the deputy judicial head of the Revolutionary Court asked the judge to replace the detention order with a release on bail before Nowruz. However, the request was turned down by the judge, who went ahead and renewed Aghayi’s detention.
